The aim of the presentation is to examine the critical issues surrounding the application of the current Product Liability Directive (85/374/EEC) to damage arising from medicinal products, particularly where such damage results from adverse effects inherent to the medicinal product itself. The analysis will then consider whether these challenges are addressed by the new Product Liability Directive (2024/2853/EU) and will present the solutions to these issues as developed in Italian case law.
The lecture is scheduled for 30 minutes, with an opportunity for discussion afterwards.
